Welder Sustained a Serious Injury at Work – Court Orders Company to Pay Moral Damages

The Lenin District Court of Mogilev considered a civil case brought by an employee seeking monetary compensation for moral damages from a large industrial enterprise. This was reported by the Mogilev Regional Court, BELTA writes.

The plaintiff worked as a mechanical assembly welder at the enterprise’s branch. In February of last year, an accident occurred at the workplace. While moving a semi‑platform with a lifting crane, it fell on the worker. The man sustained multiple severe bodily injuries.

The worker spent a long time in inpatient care, underwent surgical intervention, and continued treatment and medical rehabilitation. He was granted a third‑degree disability rating with a 30 % loss of professional working capacity, and with contraindications to employment that exclude him from work in his specialty.

As noted in court, the investigation of the accident revealed violations of safety requirements both by the victim and by other employees of the enterprise.

However, the court emphasized that gross negligence in the victim’s actions was not established.

In his claim, the plaintiff requested that the court order the defendant to pay monetary compensation for moral damages amounting to 70,000 rubles, as well as the incurred court costs.

The court concluded that the plaintiff’s health was harmed by the impact of a high‑risk source—the lifting crane owned by the defendant. The defendant’s argument that the injury resulted from the plaintiff’s intentional actions was deemed untenable, as no corresponding evidence was presented, the court noted. The court

The court’s decision in favor of the plaintiff awarded compensation for moral damages amounting to 35,000 rubles and 1,250 rubles for the reimbursement of legal assistance costs.

After reviewing the legality and justification of the first‑instance court’s decision, the civil division of the Mogilev Regional Court upheld it unchanged.
