Currently, one of the most common violations among commercial organizations and individual entrepreneurs is the payment of wages "in envelopes," that is, payment for employees' labor without proper documentary formalization and reflection in accounting and tax records. However, behind this apparent benefit usually lie risks that ultimately affect both the employee and the employer.

When labor relations are officially formalized, wages go through the mechanisms provided by law. This means that the employee can count on prescribed payments in the event of insured events—including benefits for temporary disability, maternity, child care, as well as other forms of social support. In addition, official record-keeping allows for the accumulation of insurance contributions and ensures the payment of insurance premiums. If income is paid without being reflected in reports, the employee often loses documentary proof of their earnings. Consequently, the chance of receiving guaranteed payments is significantly reduced.

The employer risks not "savings" but additional assessments: the "gray" scheme means that mandatory taxes and payments are not properly collected. Legislation increases the liability of employers (tax agents) when tax authorities identify cases of unlawful failure to withhold personal income tax:

  • an increased personal income tax rate of 26% is applied when calculating income tax on the aforementioned amounts;
  • the obligation to pay it is placed on the tax agent. The tax is paid at the expense of the tax agent's own funds and without subsequent withholding from the individual who actually received the income.
