Rights protection: how trade unions helped correct violations at Mogilev enterprises

September 4, 2026 16:00 Trade union monitoring of compliance with labor legislation in organizations of the Mogilev region allowed for the timely identification and elimination of a number of violations, including those related to the attraction of employees to disciplinary liability, the press service of the Federation of Trade Unions of Belarus reported.

The check was conducted by Andrey Kosharkar, the chief legal inspector of labor of the Belarusian Trade Union of Workers of Trade, Consumer Cooperation and Entrepreneurship. At one of the organization's branches, a trade union lawyer drew attention to the situation regarding the disciplinary liability of a personnel specialist. After a shortage was discovered at the retail facility, the employee was issued a reprimand. The employer cited "poor personnel selection," lack of control over financially responsible persons, and an insufficient personnel reserve for similar situations as grounds.

When applying the disciplinary sanction, the procedure prescribed by law was not followed—the employee was not asked for a written explanation. Furthermore, the grounds cited by the employer did not fall within the job duties of the personnel specialist. "Applying disciplinary sanctions to an employee for something that is not part of his direct job duties is unlawful. Moreover, attracting an employee to disciplinary liability without requesting a written explanation is also a violation," Andrey Kosharkar noted. Following the review of the situation, the trade union lawyer indicated the need to cancel the issued order.

The monitoring continued at the parent enterprise, where violations of labor legislation concerning the application of certain of its norms were also identified. Based on all established facts, the trade union lawyer issued recommendations to the employer on eliminating the violations. These were promptly reviewed, after which the necessary measures were taken.

The Federation of Trade Unions noted that conducting legal monitoring allows for the timely identification of violations of labor legislation and the taking of measures to protect employees' labor rights.
