In Belarus, they identified cases when the location of a land plot does not need to be approved.

Preliminary approval of the location of a land plot is usually a mandatory step when it is earmarked for construction. However, the Land Code of Belarus provides for a number of exceptions.

The State Property Agency explained in which cases this procedure will not be required.

When approval can be omitted

According to Article 41 of the Land Code of the Republic of Belarus, preliminary approval of the location of a land plot is not required if the placement of the object is already provided for in approved urban‑planning documentation.

The exception also applies to the construction and maintenance of State Border infrastructure within the border zone and border strip.

Preliminary approval can also be omitted for the construction, maintenance, or restoration of cellular communication facilities, overhead power lines, and telecommunications. However, this does not apply to agricultural land and forest‑fund land.

There are also other exceptions

The procedure is also not required for plots that already contain capital buildings, linear structures, or historic‑cultural heritage objects owned by land users on a legal basis.

Another exception concerns objects whose location and size are determined by a decision of the President of Belarus or by state programs.

In addition, preliminary approval will not be needed for industrial‑park objects if their placement is provided for in the master plan. The exception is the territories of the reserves “Volmyanskiy” and “Mayak”.
