The Kostyukovichi District Department of the Mogilev Regional Administration of the Social Protection Fund of the Population of the Ministry of Labor and Social Protection of the Republic of Belarus informs.

Effective October 5, 2026, paragraph thirty-six of point 226 of the Rules for Passenger Road Transport, approved by the Council of Ministers of the Republic of Belarus Resolution No. 147 of March 31, 2026 "On the Transport of Passengers and Cargo", comes into force, according to which a road carrier must conclude an employment contract with the driver of a vehicle engaged in passenger road transport (except for an individual entrepreneur conducting activities independently without involving other persons).

IMPORTANT! Concluding a civil-law contract whose subject is the performance of work, provision of services, and creation of intellectual property objects between a road carrier and a driver of a vehicle engaged in passenger road transport is not permitted.

Therefore, all concluded civil-law contracts must be terminated, employment contracts must be concluded with the workers, and the Fund's authorities must be provided with "Information on Hiring and Dismissal" (form PU-2) within the timeframes established by the Rules for Individual (Personalized) Accounting of Insured Persons in the State Social Insurance System, approved by the Council of Ministers of the Republic of Belarus Resolution No. 742 of December 20, 2025.

A citizen who agrees to work without an employment contract with them and, accordingly, to receive hidden wages (not reflected in the employer's accounting) should remember that they risk not receiving wages for worked time, compensation for unused vacation, sick leave payment, the employer may at any time refuse the worker, and in the future, due to non-payment of compulsory insurance contributions, such work will not be counted toward work experience when assigning a pension.

Furthermore, effective October 25, 2026, amendments to the Decree of the President of the Republic of Belarus dated January 25, 2024 No. 32 "On Passenger Road Transport" come into force, adding paragraph 2.7 "Grounds for suspending inclusion in the Register of Information concerning business entities":

• existence of tax (fee) arrears and/or payments to the budget of the state extra-budgetary fund for social protection of the population of the Republic of Belarus in an amount exceeding 1,000 basic units for two consecutive months from the moment they arise;
• failure to submit to the Fund's authorities documents of individual (personalized) accounting for drivers with whom employment contracts have been concluded.

In the presence of such grounds, the Transport Inspectorate suspends inclusion in the Register of Information for: a driver — up to one month; a vehicle — up to three months; a road passenger carrier, a dispatcher of irregular passenger road transport, a taxi dispatcher — up to three months.
