We tell the bosses what employees need to remember if the employer changes the days of salary payment.

The Ministry of Labour and Social Protection clarified what employees need to know if an employer changes the days on which wages are paid. sb.by was informed of this by the ministry’s press service.

It is noted that changing the dates of wage payments constitutes a change of substantial employment conditions. The payment day cannot simply be moved: the established procedure must be followed.

— Wages are paid no less than twice a month, on specific days set out in the collective agreement, the agreement, and the employment contract. The wording “from…to…”, “no later than…” instead of a specific payment day constitutes a violation, — the ministry explained.

When changing the dates, the employer must give written notice to the employee no later than one month in advance, conclude an additional agreement to the employment contract, make corresponding changes to the collective agreement and any other agreement if they exist, and formalize the changes by order or directive and provide the employee with a copy for signature.

The Ministry of Labour noted that if an employee refuses to continue working due to a change in substantial employment conditions, the employer will proceed with dismissal, final settlement, including severance pay equal to at least two weeks’ average earnings, and issue the employment book.
