Valentina Rudaya on the possibilities of 'land amnesty'

Until January 1, 2028, a so-called land amnesty is in effect in Belarus. It provides an opportunity to legalize certain self-occupied land plots in a simplified procedure and to avoid serious consequences in the future. However, this opportunity does not apply to all cases, so it is important for plot owners to consult in a timely manner and not to delay addressing the issue.

Many residents of the district have heard of the "land amnesty" at least once. For some, it is an opportunity to formalize a few occupied square meters of land near their home; for others, it is a chance to avoid the costly demolition of buildings. Valentina Rudaya, head of the land management department of the Droginichy District Executive Committee, tells who and under what conditions the right to legalize the violation is granted.

– "Land amnesty" is a state mechanism that allows for the simplified legalization of land plots and the objects located on them if they are used in violation of land legislation, – emphasizes Valentina Vasilievna. – Previously, in such situations, users of self-occupied land had to vacate the territory. This involved moving fences, demolishing outbuildings, and even residential houses. But today, the legislation provides an opportunity to resolve the issue differently, but only subject to a number of conditions.

As Valentina Vasilievna notes, not every self-occupied plot can be legalized. First and foremost, the fact that the plot was occupied before September 1, 2022, must be confirmed. In addition, the absence of judicial disputes and conflicts with neighbors is not allowed. A mandatory condition is the consent of adjacent land users, as well as a positive conclusion from the commission on the consideration of issues of unauthorized construction.

Those who intend to legalize a land plot must apply to the local executive committee at the location of the land with the appropriate statement. If necessary, specialists from the land management department of the Droginichy District Executive Committee are ready to explain the procedure and help clarify the specific situation.

– Every violation is under control, so not a single issue will be left without attention, – emphasizes the interlocutor. – Every building and land plot must have an owner, be registered on legal grounds. It is like a person's passport. And the ongoing "land amnesty" helps to bring order to this.

After the expiration of the "land amnesty", decisions regarding unauthorized construction will be made in accordance with Article 223 of the Civil Code of the Republic of Belarus, which does not exclude the demolition of unauthorized buildings and the return of illegally occupied land plots in the manner prescribed by law.

– Therefore, those who still have unresolved land issues should take advantage of the opportunity today, without waiting for the expiration of the statutory period, – summed up Valentina Rudaya.
