Minchanka told on Threads about an unpleasant situation that her family encountered in one of the city's establishments. Visitors wanted to order dishes from the children's menu not only for their children but also for themselves, but they were refused.

"We came as a whole family to the 'Kitchen' cafe. We weren't hungry, just wanted to snack and pass time between dental appointments. Ordered four items from the children's menu. When the waiter asked: 'Will the kids be able to handle all this?' I answered: 'Well, we'd do it ourselves too.' And then the waiter replied: 'Children's menu is only for children. We can't prepare this for you, such policy of our establishment.' This was our first encounter with such a situation. <...> I often take something from the children's menu at establishments even when we go there without children. And we have never been refused – says the girl."

After being refused to prepare meals from the children's menu, the family left the establishment.

— Then I thought: "Why didn't I ask for a complaint book, call anyone from administration?" And generally, where is it written that an adult cannot order dishes from the children's menu? But in the moment I wrote out of surprise and decided that the best solution would be simply to leave.

For comments on the situation we also contacted employees at the cafe "Kuhnya", but there they told us that they could provide feedback on the situation a little later. If we receive explanations from the establishment, we will supplement the news.

Can adults order dishes from the children's menu? Answer by a lawyer

Consumer rights specialist, lawyer Ivan Raykevich explains: an eating establishment may independently establish rules of conduct for visitors if they do not contradict legislation (para. 37).

— However, let's look, do the conditions proposed by the establishment limit the consumer's rights? Indeed, para. 1 of Art. 27 of the Civil Code of the Republic of Belarus states that for a minor's transaction only its legal representative - one of the parents, adoptive parents, guardians (with some exceptions) can make a contract on their behalf. Orders from the children's menu for children are made by parents. A child will eat all or part of this food - it cannot be a matter of interest for the establishment. In fact, would a waiter watch whether a child or parent ate a spoonful of pasta - would the parent even have time to swallow it?

I do not see legal grounds for limiting the consumer in the right to free choice of goods, works or services, which is guaranteed under art. 5 of the Law "On Protection of Consumer Rights". Only the consumer can decide how much and what kind of food to order and what to do with it, if the child does not eat it - adds the lawyer.
