
The head of the petroleum products warehouse of one of the agricultural organizations in the Kirovsky district was ordered to compensate for a gasoline shortage amounting to more than 3,000 rubles. The woman disagreed with this decision and turned to the prosecutor's office.
The shortage was discovered during an inventory of the fuel and lubricants warehouse. Following this, the enterprise's manager issued an order to recover the damage from the warehouse keeper. Part of the amount — more than 800 rubles — had already been withheld from her.
The prosecutor's office conducted an investigation and found that the employee was not at fault for the shortage. The fuel disappeared due to a malfunction of the refueling equipment and the enterprise's failure to ensure its proper operation.
Moreover, to hold an employee materially liable, the mere fact of damage is insufficient. It is also necessary to establish the unlawfulness of their actions or omissions, the link between them and the damage, and the employee's guilt.
In the end, the prosecutor's office demanded that the order for recovery be canceled. The enterprise's manager complied with the demand, and the woman was returned more than 800 rubles that had already been withheld by that point.
