The employer wants you to work on a day off. What compensation can you expect?

For work on a day that is a scheduled day off for you, you are entitled to your regular salary for the hours worked and an additional payment for each hour:

  • if paid hourly, not less than the hourly rate (the hourly portion of the salary);
  • if paid piece‑rate, not less than the piece‑rate rates.

Instead of the additional payment, you may take a day off – with the agreement of the employer and the worker's consent.

The worked time will be paid, and instead of the additional payment, another unpaid day off will be provided.

If the day off coincides with a state holiday

If the holiday is declared a non‑working day, the following rules apply for compensation for working on a holiday:

  • salary and additional payment are due regardless of whether work is scheduled or not;
  • if the work was performed beyond the monthly working time quota, you may also be granted another unpaid day off – in addition to the additional payment;
  • if the work was performed within the monthly quota, an additional day off is not provided.

How is work on a day off formalized?

In general, your written consent is required. The employer issues an order or directive specifying the compensation terms. Work can only be assigned without consent in exceptional cases provided by law.
