Starting October 5, paragraph thirty-six of clause 226 of the Rules for Road Transport of Passengers, approved by Resolution No. 147 of the Council of Ministers of the Republic of Belarus dated March 31, 2026, "On the Transport of Passengers and Goods," comes into force, according to which a motor carrier is obliged to conclude an employment contract with the driver of a vehicle performing road transport of passengers (except for an individual entrepreneur carrying out activities independently without engaging other persons).

IMPORTANT! It is not permissible for a motor carrier to conclude a civil-law contract with a driver of a vehicle performing road transport of passengers, the subject of which is the performance of work, provision of services, and creation of intellectual property objects.

In this regard, all concluded civil-law contracts must be terminated, employment contracts must be concluded with employees, and "Information on Hiring and Dismissal" (form PU-2) must be submitted to the bodies of the Fund within the time limits established by the Rules for Individual (Personalized) Registration of Insured Persons in the State Social Insurance System, approved by Resolution No. 742 of the Council of Ministers of the Republic of Belarus dated December 20, 2025.

A citizen who agrees to work without an employment contract being concluded with him and, accordingly, to receive hidden wages (without reflecting them in the employer's accounting records) should remember that he risks not receiving wages for the time worked, compensation for unused vacation, and sick leave pay; the employer may dismiss the employee at any time, and in the future, due to non-payment of mandatory insurance contributions, such work will not be counted toward the length of service when assigning a pension.

In addition, from October 25, 2026, amendments to Decree No. 32 of the President of the Republic of Belarus dated January 25, 2024, "On Road Transport of Passengers" come into force, supplementing it with clause 2.7. Grounds for suspending the presence in the Register of information regarding business entities:

• the presence of debt on payment of taxes (fees) and (or) payments to the budget of the state extra-budgetary social protection fund of the population of the Republic of Belarus in an amount exceeding 1,000 base values for two consecutive months from the moment of its formation;
• failure to submit to the bodies of the Fund documents of individual (personalized) registration regarding drivers with whom employment contracts have been concluded.

If such grounds exist, the Transport Inspection suspends the presence in the Registry of information regarding: a driver — for up to one month; a vehicle — for up to three months; a road carrier, a dispatcher of passenger road transport in irregular service, and a taxi dispatcher — for up to three months.
