Is it possible to build a house and a bathhouse at the dacha without a project?

For building a garden shed or a bathhouse on a dacha, there is no need to collect a pile of papers and order a project — it is enough to simply register the finished structure in the State Registration and Cadastre Agency (BRITI). At the same time, each plot in a garden partnership has limits on fence heights, setbacks from neighbors, and even the keeping of animals. Zakhar Ladutko, an attorney with the Minsk Regional Bar Association, has analyzed in detail the main requirements for dacha construction.

Thus, for an ordinary chicken coop, one will have to collect consents from all neighbors around the perimeter, and keeping pigs or cows in partnerships is generally forbidden. Together with domovita.by, we will figure out exactly what is permitted to build on a dacha and what nuances should be considered before starting work.

A house and a bathhouse without a project, but with the correct setback

Before purchasing building materials, the plot owner should look at the basic documents of their dacha cooperative. Construction on the territory is regulated by the regulations of the garden partnership, its charter, and internal rules. Also directly influencing this are decisions made at the general meeting or by the board of directors.

According to the general rules, it is permitted to erect both a light summer house and a capital version with heating for year-round use on the land. Among the auxiliary buildings, a garage, a shed, a canopy, and even a bathhouse can be easily placed on the plot. The main thing in this matter is to maintain the required distance from the neighboring territory. A garden house must be located at least 3 meters from the boundary of the adjacent plot. For a garage, shed, canopy, and other auxiliary buildings, the requirements are softer: they only need to be set back at least 1 meter into one's own plot from the neighbors.

A pleasant bonus for dacha owners is the absence of a long approval process for building structures. To erect a garden house or auxiliary blocks, there is no need to develop and approve project documentation at all. There is also no need to assemble a special acceptance commission after the work is completed. Once the box and the roof are ready, the owner only needs to submit an application to the local State Registration and Cadastre Agency (BRITI) and register the capital structure as built.

A chicken coop by consent and a ban on pigs

With auxiliary farming on a dacha, everything is much stricter than with the construction of a garage. Raising small agricultural animals or poultry on the plot is permitted, but only after prior approval from the neighbors. Consent will have to be obtained from the owners, proprietors, or tenants of all adjacent plots.

The structures for housing animals also require an increased distance from a neighbor's fence. A chicken coop or an enclosure for breeding goats and sheep is permitted to be placed no closer than 4 meters from the boundary of the adjacent plot. However, opening a full-fledged farm on a dacha plot is out of the question: garden cooperatives have a complete ban on keeping cattle, horses, and pigs.

Fence height and warnings from the board

Specific regulations are outlined for fences to prevent garden cooperatives from turning into labyrinths of solid walls. On the boundary with neighboring plots, the height of the enclosure should not exceed 1.7 meters. On the side facing a road or driveway, as well as along common-use areas, the fence is permitted to be raised to a maximum of 2 meters.

If these rules are ignored and the plot is built up however one pleases, the issue will quickly reach the cooperative's management. For violations of construction regulations, the cooperative's board has the right to issue an official warning to the landowner. This document will specify a specific deadline by which the owner of the plot must rectify all construction deficiencies.
