Trade union monitoring of compliance with labor legislation in organizations of Mogilev Oblast has made it possible to identify and promptly eliminate a number of violations, including those involving disciplinary action against employees, the press service of the Federation of Trade Unions of Belarus reported.
The inspection was carried out by Andrei Kosharkar, chief legal labor inspector of the Belarusian trade union of workers in trade, consumer cooperatives, and entrepreneurship. In one of the organization's branches, the union lawyer drew attention to a situation involving disciplinary action against an HR specialist. After a shortage was discovered at a retail outlet, the employee was issued a reprimand. As grounds, the employer cited "poor-quality staff selection," lack of control over financially responsible persons, and an insufficient staff reserve for similar situations.
When imposing the disciplinary penalty, the procedure prescribed by law was not followed — the employee was not asked for a written explanation. Moreover, the grounds cited by the employer did not relate to the HR specialist's job duties. "Applying disciplinary measures to an employee for something that is not, in principle, within the scope of their direct job duties is unlawful. Furthermore, bringing disciplinary action without requesting a written explanation is also a violation," noted Andrei Kosharkar. Based on the review of the situation, the union lawyer indicated the need to cancel the issued order.
The monitoring continued at the parent enterprise, where violations of labor legislation related to the application of certain of its provisions were also identified. Based on all the established facts, the union lawyer issued recommendations to the employer on eliminating the violations. They were promptly reviewed, after which the necessary measures were taken.
The Federation of Trade Unions noted that conducting legal monitoring allows for the timely identification of violations of labor legislation and the adoption of measures to protect workers' labor rights.
