Receiving part of one's salary "in an envelope" may seem profitable only at first glance. In reality, both the employer and the employee are at risk — ranging from financial losses to criminal liability.
The potential consequences were discussed on STV by Zakhar Ladutko, a lawyer at the Minsk Regional Bar Association.
Businesses risk taxes, penalties, and liability
According to the lawyer, paying salaries "in envelopes" allows companies to save on taxes and contributions to the Social Security Fund. However, if such violations are uncovered, the consequences can be serious.
Modern methods used by law enforcement agencies make it possible to establish facts of unofficial payments fairly quickly. If it turns out that a company paid its employees off the books, it may be assessed additional charges for unpaid personal income tax and contributions to the Social Security Fund.
In addition, penalties are accrued on the additional charges. Administrative liability is also provided for the legal entity and its head.
In some cases, the matter can lead to criminal liability
There are more serious consequences as well. As Zakhar Ladutko noted, if the amount of personal income tax evaded exceeds 1,000 base units, and the arrears of contributions to the Social Security Fund exceed 2,500 base units, criminal liability may apply.
The guilty parties in such cases face punishment, up to imprisonment for a term of up to three years.
At the same time, the auditing authorities may focus not only on the very fact of unofficial salary payments but also on the origin of the cash used to pay workers. If questionable transactions are discovered during the inspection, liability may also be imposed on the head and the legal entity.
Employees lose more than just some of their social guarantees
According to the lawyer, the consequences of receiving salary "in an envelope" affect not only the employer. The employee themselves also risks losing part of their social guarantees.
If the official salary is minimal, the contributions to the Social Security Fund will be correspondingly small. Going forward, this can affect the amount of pension payments, and also limit social guarantees related to unemployment benefits and temporary disability benefits.
There is also another problem. When a person's official income is significantly lower than their actual expenses, tax authorities may have questions regarding the sources of the person's funds.
In addition, low official income can affect the ability to obtain a loan for a large amount.
Unofficial salaries can be reported anonymously
The lawyer also reminded: if a worker is aware of wages being paid "under the table," they can report it anonymously to the Department of Financial Investigations of the State Control Committee through the organization's official website.
