MogilevNEWS.by 10.09.2026 On one construction site, the customer, developer, designer, engineering organization, and contractor can work simultaneously. Each has its own area of responsibility, but in practice these roles are often confused. A particularly common question is how an engineering organization in construction differs from the customer or the designer.

The main difference is simple: the designer develops the project, the contractor performs the work, and the engineering organization helps the customer organize and control the project implementation. At the same time, the scope of its authority is determined by the contract.

Engineering organization: who engages it for construction and why

An engineering organization provides engineering services to the customer or developer and performs the functions delegated to it within the scope of the contract. This can be either separate support for a specific stage or comprehensive management of construction activities.

For reference. According to clause 1.26 of the Code of the Republic of Belarus on Architectural, Urban Planning and Construction Activities (hereinafter — the Code), an engineering organization is a legal entity or individual entrepreneur engaged by the customer or developer to provide engineering services.

Depending on the terms of the contract, the services of an engineering organization may include:

• collection of initial data and preparation of documents;
• participation in the selection of contractors and suppliers;
• preparation of draft contracts;
• organizing interaction among construction participants;
• technical supervision;
• participation in the acceptance of completed works and the facility;
• performance of other tasks stipulated by the contract.

Therefore, engineering support for construction is not limited to technical supervision alone. The customer can delegate a significant portion of the current organizational work to the engineering organization while retaining decisions that the law assigns directly to its authority.

Customer and developer: similar roles with different authority

A customer in construction and a developer in construction are not the same person merely under different names. Legislation defines different roles for them, so using the expression “customer-developer” as a universal designation is not always correct.

For reference. Clause 1.19 of the Code states that a customer is a legal entity or individual carrying out construction activities with the mandatory involvement of a contractor, with or without the involvement of an engineer (engineering organization) on the basis of contracts.

According to clause 1.20 of the Code, a developer is a legal entity or individual that finances construction activity and also carries out construction of facilities for its own needs independently, with the involvement of an engineer (engineering organization), with or without the involvement of a contractor to perform certain types of work on the basis of contracts.

Thus, the key difference relates to the role of each participant: the customer carries out construction activity with the mandatory involvement of a contractor, while the developer finances construction and may carry it out independently for its own needs. At the same time, the transfer of some functions to an engineer does not mean the automatic transfer of the status of customer or developer. The functions of the customer and developer that, under the law, must be performed by them independently remain with the respective participant.

The contractor directly performs construction work on the basis of a contract concluded with the customer or developer in cases provided for by legislation.

For reference. According to clause 1.48 of the Code, a contractor is a legal entity or individual entrepreneur that has the right to carry out construction activity and has concluded a construction contract with a customer, developer, engineer (engineering organization) for the purpose of carrying out this activity.

The designer is responsible for the project, and the engineering organization is responsible for supporting its implementation.

The engineering organization and the developer of design documentation participate in the same project but perform different tasks. The developer of design documentation (often referred to in practice as the designer) formulates design solutions. The general designer, in addition, ensures the mutual coordination of the sections of the design documentation.

For reference. According to clause 1.57 of the Code, a developer of design documentation is a legal entity or individual entrepreneur engaged by the customer or developer to develop design documentation and having the right to carry out this type of activity;

The engineering organization works from the other side — it helps the customer organize the implementation of the project, interact with contractors, monitor the performance of work, and carry out technical supervision if such a function has been assigned to it by the contract.

The simplest way to distinguish these roles is as follows: the designer determines what and how should be implemented in the project, and the engineering organization helps organize and monitor the implementation of these decisions in practice.

What functions can be transferred to an engineering organization, and which remain with the customer

The parties define the scope of engineering services in the contract. It is important not merely to list the engineering organization's tasks, but to establish its authority, responsibilities, the procedure for interacting with other participants, and liability.

What should be specified in the contract with the engineering organization:

• what engineering services it provides;
• what actions it is entitled to take on behalf of the customer or developer;
• what documents it prepares and signs;
• in which procedures it participates;
• for which results it is responsible;
• what powers remain with the customer or developer.

At the same time, the delegation of the customer's functions has limits. An engineering organization cannot be given absolutely all construction-related decisions. The customer or developer retains, in particular, the decision to proceed with construction, approval of the design documentation, securing financing, the decision to mothball the facility, approval of the acceptance committee's composition, and the acceptance act.

Thus, engineering services allow the customer to delegate a significant portion of the day-to-day work to a professional organization, but do not remove the customer from the construction process itself.

The logic of the division of roles is as follows:

customer or developer makes key decisions → design documentation developer develops the project → engineering organization organizes and supports the project implementation within the transferred authority → contractor performs the construction work stipulated by the contract.

This is precisely why an engineering organization does not replace the customer, the design documentation developer, or the contractor. Its task is to professionally support construction activities to the extent that the customer or developer has delegated to it under the contract.
