From October 5, 2026, paragraph thirty-six of clause 226 of the Rules for Road Transport of Passengers, approved by Resolution No. 147 of the Council of Ministers of the Republic of Belarus dated March 31, 2026 "On the Transport of Passengers and Goods", comes into force. According to the new provision, a road carrier is obliged to conclude an employment contract with the driver of a vehicle performing road transport of passengers. The exception is an individual entrepreneur carrying out activities independently without engaging other persons.

IMPORTANT! It is inadmissible for a road carrier to conclude a civil law contract with the driver of a vehicle performing road transport of passengers, the subject of which is the performance of work, provision of services, and creation of intellectual property objects.

All previously concluded contracts of this kind must be terminated, and employment contracts must be concluded with the employees. It is necessary to submit "Information on Hiring and Dismissal" (form PU-2) to the Fund authorities within the time limits established by the Rules for Individual (Personalized) Registration of Insured Persons in the State Social Insurance System, approved by Resolution No. 742 of the Council of Ministers of the Republic of Belarus dated December 20, 2025.

What are the risks for workers? A citizen who agrees to work without an employment contract and, accordingly, to receive hidden wages (without reflecting them in the employer's accounting records) risks being left without wages for the time worked, compensation for unused vacation, and sick leave pay. The employer can refuse such a worker at any time. In addition, due to non-payment of mandatory insurance contributions, this work will not be counted toward the length of service when assigning a pension.

New grounds for suspension in the Register. From October 25, 2026, amendments to Decree No. 32 of the President of the Republic of Belarus dated January 25, 2024 "On Road Transport of Passengers" come into force. Clause 2.7 has been supplemented with new grounds for suspending the presence of information regarding business entities in the Register:

• the existence of arrears in the payment of taxes (fees) and/or payments to the budget of the state extra-budgetary social protection fund of the population of the Republic of Belarus in an amount exceeding 1,000 basic units, for two consecutive months from the moment such arrears arose;
• failure to submit to the Fund's authorities documents of individual (personalized) accounting with respect to drivers with whom employment contracts have been concluded.

If these grounds exist, the Transport Inspectorate suspends the presence in the Register of information concerning: a driver — for up to one month; a vehicle — for up to three months; a motor carrier, a dispatcher of road passenger transport in irregular service, a taxi dispatcher — for up to three months.
