Paragraph 1 of Article 22 of the Civil Code of the Republic of Belarus (hereinafter – the CC) stipulates that when conducting individual entrepreneurial activity as an individual entrepreneur, a citizen may engage no more than three natural persons under employment and/or civil law contracts, whose subject matter is the performance of work, provision of services, or creation of intellectual property objects.

According to paragraph 4 of the aforementioned article of the CC, individual entrepreneurial activity carried out by a citizen in violation of the above requirements is unlawful.

Based on the foregoing, entrepreneurial activity carried out by an individual entrepreneur with the involvement of natural persons without entering into employment and/or civil law contracts with them is unlawful, and such acts constitute the elements of an administrative offense under part 3 of Article 13.3 of the Code of Administrative Offences (CO
