An open sick leave means that the employee is released from performing work duties. It does not matter whether they are in the office or working remotely: remote employment is also considered work.
The Ministry of Labor explained why it is not possible to receive both salary and temporary disability benefits during sick leave.
Sick leave frees one from work, including remote work.
The incapacity certificate confirms that the person is exempt from work for the specified period. Therefore, performing work duties during sick leave is prohibited, even if it does not require coming to the office.
Remote format does not change the essence: if an employee continues to perform tasks and receives salary for it, that is considered work. One cannot receive both salary and temporary disability benefits for the same days.
Can one work part‑time if sick leave is open at the primary workplace?
The requirement to be released from work applies to all places of employment. Therefore, if a person has taken sick leave at their primary workplace, continuing to work part‑time during that period is also prohibited.
To be entitled to the benefit, the employee must be released from duties at all places of work.
